5. Privacy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.
6. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SKIP IT. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Dispute Resolution; Arbitration; Class-Action Waiver
Governing Law.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.
Arbitration.
You and SKIP IT. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules then in effect. The seat and locale of arbitration will be Boston, Massachusetts, unless we both agree otherwise. Judgment on the award may be entered in any court of competent jurisdiction.
No Class Actions.
You and SKIP IT. agree to bring claims only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
Small-Claims Carve-Out.
Either party may bring an individual action in small-claims court in a jurisdiction that has such court.
30-Day Opt-Out.
You may opt out of this arbitration provision by emailing legal@skipit.tech within 30 days of first accepting these Terms, stating your full name and the email associated with your account, and clearly indicating your wish to opt out. Opting out will not affect your other obligations under these Terms.
Injunctive Relief.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court to protect its rights pending arbitration.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
10. Contact Information
